A Regular monthly meeting was held on Wednesday, March 10, 2010 at 6:30 p.m. in the Village Hall, 8892 South Street.

Mayor Saroodis called the meeting to order at 6:30 p.m. and led the Pledge to the Flag.
An additional change order for MEC Electric in the amount of $2,711.97 and D’Amico Plumbing in the amount of $2,420.58. were received due to changes requested by the Village for additional work at the Lab.
Eric Pond stated he is happy with the progress at the plant. Bongiovanni is a good contractor and has been very good to work with. The project is 60% through construction.
CORRESPONDENCE:
Fire Chief Winslow reported the Department answered 48 alarms in the month of February. Adam Rude was introduced to the Board as a Level I (Under 18 years of age) firefighter. The Board was reminded of the annual Cayuga County Chiefs Academy at the Weedsport High School on March 13th. The Board was invited to the annual election night dinner on Tuesday April 6th at DeVaneys Restaurant starting at 5:30 p.m. Mayor Saroodis asked to have copies of the membership physicals that were taken in December 2009. The Chief said he would get copies for our files.
US Tanker sent copies of a change order that needs to be signed. The Village Board agreed to have the Fire Department handle the revised specifications. No cost change is reflected for the changes requested.
Trustee Lukins offered the following resolution and moved for its adoption:
RESOLVED, that the Village of Weedsport approves continued participation by the Weedsport Fire Department, in the Cayuga County Fire Mutual Aid Annex as now in effect and as amended from time to time and certifies to the Cayuga County Legislature through it Fire Coordinator that no restriction exists against “outside services” by such fire company and/or fire department within the meaning of Section 209 of the General Municipal Law which would affect the power of such fire company/fire department to participate in such plan.
AND BE IT FURTHER RESOLVED, that a copy of this resolution be filed with the Cayuga County Fire Coordinator. Trustee Swim seconded this motion.

Paul Goodrich with the ATV Club was present to supply a map of the trail the Club is anticipating using in the Village. The Club still needs permission from Lefluer, 2655 W. Brutus St. to use his property to connect to the trail. Mr. Goodrich invited the Board to attend an appreciation Spaghetti Dinner on March 27th in Montezuma. The Board instructed the Clerk to send a letter to Jeff Mills in regards to the damaged Welcome sign on Rt. 31 between Weedsport and Port Byron. This sign was damaged by snowmobiles.
The Board read the monthly Police report. Officer Gilfus informed the Board DCJS has notified him the Grant Award is available. The Department is installing computer systems in both patrol cars that are the same as what the Troopers and Sheriff’s Department use. Officer Androsko updated the unregistered vehicle log. Summons will be issued for vehicles that have reached the six-month time period. The Police and Fire Department will host a bicycle safety event on May 15, from 10 a.m. to 12 p.m. at Trolley Park. Free bicycle helmets will be given out, along with T-shirts, food and drinks.
The Board reviewed the monthly report from the Judge. It was noted the Court received a grant in the amount of $5,318.75.
The Board read the monthly report of activities for the Department of public works. Superintendent Saroodis informed the Board the bleachers have been delivered to Trolley Park. Ron Spingler has started installing new radio read meters for the upgraded program for billing.
A motion by Trustee Lukins, seconded by Trustee Perkins, all aye to approve Jim Saroodis, Ron Spingler and Barry Walters to attend the Rural Water Conference May 24 through May 27 in Vernon, NY.
The Board was reminded of the second public hearing to be held on March 25, at 7:00 p.m. in the Village Hall for the application process for the Community Development Grant. The Clerk also informed the Board the Town of Brutus will hold a public information meeting on March 15th at 7:00 p.m. at the High School in regards to the Cottle Road water issue.
Trustee Hinman made the motion, second by Trustee Perkins, all ayes to approve the following resolution:
WHEREAS, The New York Main Street Program (NYMS) provides funding to assist New York State communities with main street/downtown revitalization efforts; and
WHEREAS, The Village of Weedsport has an interest in improving the main street/downtown area of the Village and would greatly benefit from the funding of this Grant; and
WHEREAS, The Board of Trustees of the Village of Weedsport wish to have Cayuga County Planning, and Homsite start proceedings to submit applications for this Grant;
NOW THEREFORE BE IT RESOLVED, The Village of Weedsport hereby authorizes the preparation and presentation to submit this Grant for the Village in the amount of $60,000.00.
SILVER STAR BANNER DAY PROCLAMATION
Trustee Hinman made the motion, second by Trustee Lukins, all ayes, to adopt the following proclamation:
WHEREAS, the Village of Weedsport has always honored the sacrifice of the men and women in the Armed Forces and
WHEREAS, The Silver Star Families of America was formed to make sure we remember the blood sacrifice of our wounded and ill by designing and manufacturing a Silver Star (Service) Banner and Flag and
WHEREAS, to date The Silver Star Families of America has freely given thousands of Silver Star (Service) Banners to the wounded and their families, and
WHEREAS, the members of The Silver Star Families of America have worked tirelessly to provide the wounded of this Village and Country with Silver Star (Service) Banners, Flags and care packages, and
WHEREAS, The Silver Star Families of America’s sole mission is that every time someone sees a Silver Star (Service) Banner in a window or a Silver Star (Service Flag flying, that people remember the (sacrificed) for this Village, State and Nation and
WHEREAS, the people and Mayor of the Village of Weedsport wish that the sacrifice of so many in our Armed Forces never be forgotten
NOW THEREFORE, I, Jean B. Saroodis, Mayor of the Village of Weedsport do hereby proclaim,
My appreciation of The Silver Star Families of America and honor their commitment to our wounded Armed Forces members. I hereby declare May 1st “SILVER STAR BANNER DAY” the permanent and official day to honor the wounded and ill Soldiers of the Village of Weedsport.

Treasurer Scheufele explained the difference in what the Town of Sennett has been billing and what the Village has been paying needs to be set aside until a resolution to the contract is determined. The amount to be encumbered from the balance remaining in F8320.410 is $34,652.85. Trustee Lukins made the motion to approve this, Trustee Swim seconded this motion, all present voted aye.
Trustee Lukins made the motion, second by Trustee Hinman, all ayes to approve encumbering Engineering contract amounts of $2000. for Bell Street and $3,720 for N. Willow Street, and a transfer from A8540.400 – drainage because A1440.400 is short $145.50. Also to add the following two bills to Abstract #14 when they arrive:
Trustee Lukins made the motion, second by Trustee Perkins, all ayes to hold a Public Hearing on March 24, 2010 at 7:00 p.m. in the Village Hall to inform residents of the anticipated increase to sewer rates for the Bond repayment on the WWTP upgrade. A Special meeting will be held on Monday March 15th at 5:30 p.m. to set the increase amount.

A RESOLUTION AUTHORIZING THE VILLAGE ATTORNEY FOR THE VILLAGE OF WEEDSPORT TO APPEAR IN AND DEFEND AN IN REM FORECLOSURE PROCEEDING IN NEW ORK STATE SUPREME COURT, ON BEHALF OF THE VILLAGE OF WEEDSPORT
The Board of Trustees of the Village of Weedsport, duly convened in regular session, does hereby resolve as follows:
Section 1. The Board of Trustees of the Village of Weedsport hereby authorizes David B. Thurston, Esq., Attorney for the Village of Weedsport, to appear and defend an In Rem Tax Foreclosure Proceeding initiated by the County of Cayuga in New York State Supreme Court civil action in New York State Supreme Court commenced under Index No. 20-09-1417 on behalf of the Village of Weedsport and to appear as the attorney for the Village of Weedsport as Defendant/Respondent.
In said Proceeding, the Village of Weedsport, as the Defendant/Respondent, shall among other things, ask the court: (a) to determine that the Village of Weedsport is a tax district that has an interest in a parcel of property sought to be foreclosed by the County of Cayuga which parcel is commonly known as 8803 South Street in the Village and designated as tax map number 83.09-3-71, (b) to determine that the Village of Weedsport has the right and power to levy and collect taxes on said parcel, (c) to determine that the Village of Weedsport has liens for unpaid taxes and assessments against said parcel, (d) that any sale or other conveyance shall be in accordance with an agreement between the County of Cayuga and the Village of Weedsport pursuant to Real Property Tax Law 1122 and 1150, (e) to otherwise protect, preserve and defend liens for unpaid taxes and assessments against said parcel held by the Village of Weedsport, and (f) for such other and further relief as to the Court may seem just, proper and equitable.
SECTION 2. This Resolution shall take effect immediately.
Trustee Perkins made the motion, seconded by Trustee Hinman, all ayes to approve the agreement between the Village of Weedsport and the Weedsport Little League for use of the Little League Field at Trolley Park during the 2010 season. A current certificate of insurance was supplied by the League.
Trustee Lukins made the motion, second by Trustee Perkins to go into Executive Session at 8:25 p.m. to discuss a personnel matter. Present in executive session was Mayor Saroodis, Trustees Swim, Perkins, Hinman, Lukins and Superintendent Saroodis. The session ended at 8:45 p.m. with no decisions being made.
