A Regular monthly meeting and four Public Hearings were held on Wednesday, January 13, 2010 at 6:30 p.m. in the Village Hall, 8892 South Street.

Mayor Saroodis called the meeting to order at 6:30 p.m. and led the Pledge to the Flag.
Trustee Perkins, made the motion, seconded by Trustee Hinman, all ayes to approve the meeting minutes of December 9th and December 23, 2009.
The Mayor opened the following Public Hearings:
Public Hearing on proposed Local Law #1-2010 – To authorize the appointments for alternate members on the combined Planning Board
Public Hearing on proposed Local Law #2-2010 – Amendments to Vehicle and Traffic Law – Speed Regulations, Parking Prohibited, Handicapped Parking
Public Hearing on proposed Local Law #3-2010 – To prohibit the installation and/or use of outdoor furnaces
Public Hearing on the Tentative Budget for 2010-2011
David Fulkerson questioned the No Parking on the north side of Lincoln Street. He thought there was no parking on either side of Lincoln Street. It was explained that there is no parking on the South side of Lincoln Street and if Local Law 2-2010 passes there will be no parking on either side of Lincoln Street. This law was thought to be passed previously however it had never been filed with the State so the process had to be repeated.
Lucas Short, 2753 Centennial Street asked if the law could be amended to make no parking on Centennial Street as well. School buses utilize this street and when cars park on Centennial Street it makes for a potential dangerous situation. He feels everyone on Centennial Street has ample parking in their own driveway. Mayor Saroodis instructed Mr. Short to get a petition signed by the residents on that street and present it to the Board to consider making this change.
CORRESPONDENCE:
The Board reviewed the police report. Police answered 53 calls for the month of December and a total of 686 calls for the year. Trustee Hinman informed Officer Gilfus that he has received complaints of traffic not stopping for the cross walk in front of the Post Office. Officer Gilfus stated he would set up something with an unmarked vehicle to ticket offenders.
Snowmobile use in the village was discussed. “ No snowmobiles on sidewalks” signs will be put up at the intersections of Van Buren & South St. Liberty & South, S. Seneca & Liberty, S. Willow and E. Brutus, Lincoln St and Furnace Street.
The Board read the monthly report of inspections by the Building Inspector. Mr. Ganey stated he has been approached by George Chester in regards to changing classification on his property at 2803 E. Brutus St. Currently it is classified as #663 “old persons home” he would like it changed to #210 residential. The Clerk spoke with Pam Kelly; Town Assessor to see what impact this would have on the Village. She said it would not change his tax rate or exemptions if he had any, which he does not. The Clerk was instructed to ask the Attorney if he was aware of any impact this change would make.
The Superintendent informed the Board the Village of Port Byron used the Village garbage truck and a driver after their garbage truck broke down. Signs have arrived for Rosewood Circle and Dorothy Court in the Village Heights Subdivision and will erect them as soon as weather and time allow. NYS Department of Labor inspected the recycling center and found two minor violations that have been repaired. The Village is required to adopt and post a Workplace Violence Policy. Training will also have to be arranged. Superintendent Saroodis reminded the Board that bids for the automated meter reading system is scheduled to be opened on January 27, at 11:00 a.m. in the Village Hall.
The Board read the Superintendents Report. Superintendent Saroodis asked the Board to consider raises the fees for Water/Sewer Installation that was instituted in 1987. One hookup ¾” water or sewer is $500. Two hookups ¾” water and sewer is $750. 1” water service only$750. With sewer hook up $1250.
A motion by Trustee Lukins, seconded by Trustee Hinman, all aye to raise fees to the water and sewer installation fees as follows:
1 hookup ¾” water or sewer $1000. standard
2 hookups ¾” water and sewer $1500. standard
1” water service only $1750. With sewer hookup
Property owners were present to complain of parking tickets issued in the municipal parking lot located on Erie Drive. Mayor Saroodis stated that this area was put in by the State and turned the lot over to the Village who is responsible for maintaining it. George Chester asked why letters were not sent to inform the tenants to move the vehicles before issuing parking tickets. Ron Ward stated he has been parking in this lot in prior years and has never received any parking tickets, and asked why tickets were issued this year. Mayor Saroodis stated that cars were parked in excess of 24 hours without moving and that is why tickets were written. The Village has tried to work with the tenants of the area but when a heavy snowfall exists, snow removal must be maintained to assure safety. Trustee Lukins stated there is a time limit for parking in the lot and it is the responsibility of the people to move the vehicles especially when snow removal is required. It was noted the municipal lots on Erie Drive and Furnace Street have time limits; eight hours during the day and 10 hours at night.
Judge Fritsch stated he recommended attendance at this meeting to those who received tickets. The Court could work with the Board on a one-time dismissal if the Board desired. Mayor Saroodis polled the Board and it was agreed that the tickets would stand as is.

LINCOLN ST.
David Fulkerson stated he feels the angle is slightly off with the survey map presented by Heather Warren, Land Surveyor. After a discussion, the Board agreed to have Heather Warren to come back and survey the extension of sewer line heading east from the manhole behind 2658 Watson Street and add it to her survey map. Attorney Thurston and Attorney Contigulia discussed making changes to the agreement. This will be re-drawn to include the manhole at 8863 S. Seneca St. and be presented to the Board for consideration.

PERMANENT WATER AND SANITARY SEWER EASEMENT(S)
Kylecroft NY, LLC, a domestic corporation with offices located at 89 York Street, Auburn, NY 13021, being the record owner of the subject property known as Village Heights Subdivision (“Grantor”) hereby grants and conveys the following Permanent Easement(s) to the Village of Weedsport (“Grantee”) located in the County of Cayuga.
WITNESSETH
WHEREAS, Grantor is the owner of the above-mentioned property, and the Grantee is desirous of using a portion of said land for Municipal Water and Sanitary Sewer purposes (“Easement Areas”).
Kylecroft NY, LLC, grants to the said Village of Weedsport a Permanent Easement(s) for the purpose set forth above, as the same that is shown on a map made by Watkins Land Surveying PLLC, which map was filed on February 15, 2007 in the office of the Cayuga County Clerk as Map 07-46.
The said Grantor, grants to the Grantee the right to lay, relay, maintain, install, operate, repair and remove pipes and conduits for the purposes of establishing, installing and maintaining Water and Sanitary Sewer facility which facilities were installed by Grantor.
Now, therefore,
In consideration of the sum of One Dollar ($1.00) and other good and valuable consideration paid by the Grantee to the Grantor, receipt whereof is hereby acknowledged, the Grantor grants and conveys to the Grantee forever the right and easement to repair, reconstruct and maintain said Easement Areas upon the premises of the Grantor of the first part, as described on Schedule A.
This conveyance is made subject to any and all covenants, easements, and restrictions of record affecting said premises
Said Village of Weedsport, by its servants, agents, and employees, shall have the right to enter upon said premises whenever necessary for the purposes aforesaid, The said premises shall be left in as good condition as found, and reasonable compensation shall be made for maintaining or repairing said Easement Areas.
The Grantor shall have the right to use the ground and said easement(s), provided that such use of said ground shall not interfere with, obstruct, or endanger any of the rights granted herein.
IT IS UNDERSTOOD AND AGREED THAT:
1. All pipes, conduits and facilities laid in the Easement Areas shall be and remain the property of the Village of Weedsport, its successors and assigns forever.
2. The Grantor shall have the right to use the land included in said easement(s) provided that such use of said land shall not interfere with, obstruct or endanger any of the rights herein granted.
3. The permanent easement(s) herein granted shall run with the land and shall be binding upon and inure to the benefit of the heirs, executors, administrators, successors and assigns of the parties hereto.
Grantor warrants it has title to the described premises and the right to convey the easement(s) herein granted.

The Board read the Fire Chief’s Report of calls. Total alarms answered for the year 2009 was 788. Tim Spingler has been granted the status of Inactive Exempt Member. The Republican Committee asked permission to use the firehouse to hold the Republican Caucus on January 23rd, at 10:00 a.m. in the event the village boardroom is not large enough and permission was granted. The Board received copies of the Cayuga County Fire Mutual Aid Annex. A copy will be given to Attorney Thurston to review before the Mayor signs it. The Board was reminded of the annual fire department banquet being held on January 30, 2010.
The Board read the monthly report. Fines brought in for the month was $8195.00.
The Board was reminded of a meeting to be held on Thursday, January 14 with Homsite and business owners in regards to the New York Main Street Program. Permission was given for the Little League to use the Boardroom on March 7th at 6:30 p.m. The final payment in the amount of $7500.00 for the Trolley Park grant has been received. It was noted that the village is hosting the February CCAV meeting and we will need to decide on a place and a speaker. The Board reviewed the updated unlicensed vehicle list.
Trustee Swim made the motion to appoint Sonja Chamberlain ® and Deb Schwarting (D) as Election inspectors for the March 16, 2010 election. Sonja Chamberlain will be designated Chairperson, alternate inspectors will be Chickie O’Connor (D) and Julie Bowden ®, Trustee Hinman seconded this motion, all present voted aye.
Trustee Hinman made the motion, seconded by Trustee Perkins, all aye to approve paying the Election Inspectors $100.00 each for the day.
The Clerk presented a Workplace Violence Policy for the Board to review and adopt. This is required by New York State Department of Labor. The Village is in violation for not having this policy in place and displayed after an inspection at the Department of public works. The Board instructed the Clerk to have the Attorney review the policy before its adoption.
Trustee Perkins, second Trustee Hinman, closed the Public Hearing on the Local Laws and Budget Hearing on a motion all present voted aye.
Trustee Hinman made the motion, seconded by Trustee Perkins, all ayes to approve the following Local Law 1-2010.

LAW NO. 1-2010
PLANNING BOARD ALTERNATES
A
local law authorizing the appointments of alternate members of the combined
Planning Board (Planning Board) of the Town of Brutus and the Village of
Weedsport.
Be
it enacted by the Board of Trustees of the Village of Weedsport as follows:
SECTION
I – AUTHORITY and PURPOSE
This
local law is enacted under the authority granted pursuant to the General
Municipal Law Article 5-G, Town Law and Village Law of the State of New York.
The purpose of this local law is to authorize the continued appointment of
alternate members to the Planning Board by correcting an omission in Local law
3 of 2009.
SECTION
II – ALTERNATE MEMBERS
A. It is sometimes difficult to maintain a quorum on the Planning
Board because members are ill, on extended vacation or find they have a
conflict of interest on a specific matter before such Board. In such instances, official business cannot
be conducted which may delay or impede adherence to required time limits. The use of alternate members in such
instances is hereby authorized pursuant to the provisions of this article.
B. This section is hereby adopted pursuant to the provisions of
§10 of the New York State Municipal Home Rule Law and §10 of the New York State
Statute of Local Governments. It is the
intent of the Town Board of the Town of Brutus and the Board of Trustees of the
Village of Weedsport pursuant to §10 of the New York Municipal Home Rule Law to
supersede the provisions of §§267 and 271 of the New York State Town Law and
§§7-712 and 7-718 of the New York State Village Law relating to the appointment
of members.
C. The number of alternate members shall be four. Two members appointed by the Board of
Trustees of the Village of Weedsport and two members appointed by the Town
Board of the Town of Brutus.
D. Alternate members originally appointed shall be appointed as
follows: the Town Board of the Town of
Brutus shall appoint two members, one each for terms of one and three
years. The Board of Trustees of the Village
of Weedsport shall appoint two members, one each for terms of two and four
years. Upon the expiration of the terms
of the original members, successors shall be appointed by the same Board as the
original member, for a term of four years.
Terms shall run from January 1 through December 31.
E. Vacancies shall be filled by the appointment of replacement
members by the same Board as appointed the member leaving office, to fill the
unexpired term of that member.
SECTION
III – CONFLICT WITH PRIOR LOCAL LAWS
If
any local laws or parts of local laws of the Village of Weedsport and the Town
of Brutus are inconsistent with any of the provisions of this local law, the
terms of this local law shall control.
SECTION
IV – EFFECTIVE DATE
This
local law shall take effect immediately upon filing in the office of the
Secretary of State of the State of New York.
SECTION
V – SEVERABILITY
If
any of this local law shall be held unconstitutional, invalid or ineffective,
in whole or in part, said determination shall not be deemed to effect, impair
or invalidate the remainder thereof.
Trustee Lukins made the motion, seconded by Trustee Perkins, all ayes to adopt the following Local Law 2-2010. Vehicle & Traffic Amendment
A local law amending the Vehicle and Traffic Law of the Village of Weedsport.
Section 1. Purpose. The purpose of this local law is to provide for the protection, health, safety and welfare of the residents of the Village of Weedsport and others using the roads, streets and highways of the Village of Weedsport by providing regulations of the use of streets, highways, roads, drives and boulevards within the Village of Weedsport.
Section 2. Authority. This local law is adopted pursuant to the authority of the General Municipal Law and the Vehicle and Traffic Law of the State of New York.
Section 3. Amendment of the Vehicle and Traffic Law of the Village of Weedsport
a. Section 198-8 (Speed regulations) is hereby amended by adding the following: Section 198-8 C. East Brutus Street. (1) Twenty miles per hour is hereby established as the maximum speed at which vehicles may proceed on East Brutus Street between Willow Street and the east line of the Village of Weedsport.
b. Section 198-7 (Parking Prohibited) is hereby amended by adding the following: Section 198-17 B. (25) On the north side of Lincoln Street from Cool Street to South Seneca Street.
c. By adding a new section as follows: Section 198-16,1 (Handicapped Parking)
A. There shall be one (1) handicapped parking space located on the south side of Franklin Street beginning at a point twenty (20) feet east of the crosswalk on Franklin Street and extending twenty five (25) feet easterly along the south line of Franklin Street.
B. The Board of Trustees of the Village of Weedsport may by resolution designate such handicapped parking spaces in Village Municipal Parking Lots, as said Board deems appropriate.
Section 4. Confirmation. The Vehicle and Traffic Law of the Village of Weedsport is hereby confirmed in all respects not amended by this local law.
Section 5. Effective Date. This local law shall be effective upon its filing with the Secretary of State of the State of New York.
Trustee Lukins made the motion, seconded by Trustee Swim, all ayes to approve the following local law.
Local Law # 3-2010
A local law prohibiting the installation and/or use of outdoor furnaces within the Village of Weedsport.
Section 1. Authority. This local law is enacted under the authority granted pursuant to the General Municipal Law, Home Rule Law and Village Law of the State of New York.
Section 2. Purpose. The purpose of this local law is to provide for the health, safety and welfare of the residents of the Village of Weedsport.
Section 3. Definitions.
A. Outdoor Furnace/Wood Boiler – Any equipment, device or apparatus, or any part thereof, which is installed, affixed or situated separate from an occupied residence or structure for the primary purpose of combustion of fuel to produce heat or energy used as a component of a heating system providing heat and/or hot water for any occupied residence, structure or space.
Section 4. Prohibition. The installation and/or use of Outdoor Furnaces/Wood Boilers is hereby prohibited within the Village of Weedsport.
Section 5. Enforcement and Penalty.
A. A violation of this local law shall be a violation and shall be punishable pursuant to the provisions of Chapter 1, General Provisions, Article I, General Penalty, of the Code of the Village of Weedsport.
B. Injunctive Relief. An action or proceeding may be instituted in the name of the Village of Weedsport, in a court of competent jurisdiction, to prevent, restrain, enjoin, correct, or abate any violation of this local law.
C. Remedies not exclusive. No remedy or penalty specified in this local law shall be the exclusive remedy or penalty available to address any violation of this local law.
Section 6. Effective Date. This local law shall take effect immediately upon filing with the New York Secretary of State.
Trustee Hinman made the motion, seconded by Trustee Perkins, all ayes to approve the Mayor to sign the Satisfaction of Mortgage by Jennifer Gilfus (Lewis) for the satisfied sum of $17,968.00.
Trustee Swim made the motion, second by Trustee Lukins, all ayes to approve the Mayor to sign the Satisfaction of Mortgage by Loretta Gagne who received a 100% deferred loan.
2010-2011 BUDGET ADOPTED
A motion was made by Trustee Swim, seconded by Trustee Perkins, all ayes to approve the Budget submitted by the Treasurer in the amount of $1,118,661 with a tax rate of $5.75 for 2010-2011.
Trustee Lukins made the motion, seconded by Trustee Perkins to approve the following list of Sidewalk Charges, delinquent water/sewer charges and the clean up of the Coyle property, and unpaid mowing charges to the 2010-2011 taxes.

Requests for proposals were sent out to audit Fiscal Year End of February 28, 2009 books. Only Cuddy & Ward LLP returned a quote in the amount of $4500. Trustee Hinman made the motion to award Cuddy & Ward the project. Trustee Lukins seconded this motion, all present voted aye.
Daniel J. D’Amico Plumbing & Heating presented a change order #1 for the Wastewater Treatment Plant in the amount of $2,489.35 to furnish and install floor drain, trap and vent for the proper installation of sludge press sump drainage per Plumbing Code which was not included in the original contract. Trustee Hinman made the motion, second by Trustee Lukins, all ayes to approve the Mayor to sign this change order.
Discussion was held on how to pay Attorney Thurston for his services. Trustee Lukins made the motion, seconded by Trustee Swim, all ayes to pay Mr. Thurston $1,000. per month by voucher.
Trustee Swim made the motion, seconded by Trustee Perkins, all ayes to allow the Mayor to sign the new collateral agreement to change the third party custodian for handling First Niagara Banks securities of the collateral of Public Funds from M&T bank to JP Morgan Chase Bank. This covers the Village deposits that are above the FDIC insurance coverage.
Updates to the budget for the HI Capital Project fund for the Wastewater Treatment Facility to reflect the additional debt of $207,845 and add change orders approved for contractors. Trustee Lukins made the motion to approve this transfer, seconded by Trustee Hinman, all present voted aye.

Superintendent Saroodis presented prices for aluminum bleachers for Trolley Park. They are handicap accessible, 27’ long and hold 75 people. He has checked around and feels this is the best price at $15,381.35. The final payoff from the grant of $7500. will be used towards the bleachers. Trustee Hinman made the motion, seconded by Trustee Perkins, all aye to approve this purchase.
The village is submitting an application to the New York State Office of Community Renewal for funding under the federal Small Cities Community Development Program in 2010. This is a Single Purpose application with an anticipated maximum funding request of $400,000 and an Economic Development application with a maximum funding request of $750,000. Trustee Hinman made the motion, seconded by Trustee Swim, all aye to hold the first public hearing on February 11, 2010 at 7:00 p.m. in the Village Hall.
The Board reviewed the annual contract and agreement with the Village and the ATV Club. It was requested to ask the president of the Club to attend the February meeting to discuss the trails before the Landowner Consent Form is signed.
Requests for proposals were advertised for cleaning the Village Offices and parts of the Fire House. Only one proposal was received from our current cleaner for the same cost as the prior two years in the amount of $416.67 a month. It was agreed to continue with Chet Hoisington DBA C&L Carpet Cleaning. Current Certificates of Workers Compensation and Certificate of Liability Insurance were submitted and put on file.
OTHER BUSINESS:
Mayor Saroodis asked the Board to give thought to what can be done with the village owned parcel at 8872 South Street currently rented by Richard Bibbens. The Board was reminded of the Homsite meeting to be held in the Village Hall on Thursday, January 14th with downtown business owners seeking NYS Main Street funding to provide financial assistance with their projects. The Village made no decisions in regards to the Town of Brutus request to provide water to proposed Water District #8. This will be addressed at a later date.
Trustee Hinman made the motion to adjourn the meeting at 9:35 p.m., seconded by Trustee Perkins, all aye.
