The Mayor called the meeting to order at 7:00PM. She then led those present in the Pledge of Allegiance.
APPROVAL OF MINUTES
The minutes of April 13, 2011 were approved on a Motion: by Ryan, second by Ellis. Approved 3/0.
OPEN TO THE PUBLIC
Romocki inquired as to the Board's consideration of his concern, expressed last month, regarding the amount of rent increase for this coming year. Mayor Day indicated that Trustees Ellis and Erickson have been assigned to review the situation and look at comparables. A response should be ready next month.
· Romocki also had other requests, which the above team will review and make recommendations to the Village Board. (1) Would the Village mow the grass from the south end of Harris Park to the end of the three homes? (2) A tree has fallen and hit his dock. Can the tree be removed? (3) Five years ago (2005), Romocki started a shore erosion project with Jim Hotaling of Cayuga County Water and Soil (CCWS). A DEC permit had been obtained for this project. Hotaling retired in the intervening years. Romocki indicated that the resources at CCWS and Cayuga County are limited. These agencies are willing to do the work, but need funding. Can the Village assist with funding?
Cuipylo reported on the progress of the Cayuga Recreation Trail. A meeting with Finger Lakes Railroad Company (FLRR) was anticipated this evening, however Cuipylo was notified at 3:30PM that representatives could not meet and the meeting will need to be rescheduled. The FLRR personnel did indicate that they would not stop the project, but will work with the Trail Committee to come up with a workable plan for crossing the railroad tracks. FLRR is willing to provide railroad ties to be used as "posts". Mayor Day asked Cuipylo to have FLRR submit a letter on what they have agreed to do.
· Sue Harris has designed a logo for the Trail. The Committee needs to apply for financing. Duane Bergerstock has volunteered to assist with maintenance of the trail. He also has an interest in building a kiosk to be placed at the beginning of the trail to show the trail route and provide directions.
· The Cayuga Recreation Trail Committee has filed a FOIL request for an access agreement to the small island owned by the DEC. There are two houses on this island.
· Motion: by Ziegler-Greer, second by Ellis to establish the Cayuga Recreation Trail Committee as a committee of the Village. Committee members appointed were Co-Chairs, Carl Cuipylo and Bruce Purdy, Jackie Komanecky and Susan Harris with Cheryl Ziegler-Greer serving as liaison to the Village Board. Motion approved 3/0.
Motion: by Ziegler-Greer, second by Ellis to make the Neighborhood Watch Committee a committee of the Village. Motion approved 3/0.
Erickson arrived.
Harris reported on the LWRP. She inquired as to whether the Board had an opportunity to review the project. Attorney Lynch was concerned that the project as outlined was not following the work plan. Harris explained that the Village is considered a Waterfront Revitalization Community and that the first step in the process was the Initial Scoping Project meeting. Scheduling the first meeting was on hold until the Trustees had an opportunity to review the NYS approved project as provided following the last Board meeting. Harris will contact John Wimbush, Department of State, who will be assisting the Village through the project to establish a time for the first meeting. The meeting was tentatively scheduled for May 24, 2011 at 4PM pending this date and time is good for Wimbush. The timeline for required reports to the State are June 30th and December 31st. Harris will be asking for an extension to the reporting time of December 31st.
· The June Newsletter will include a brief description of the Plan and a request for interested persons to serve on the Visioning Committee or the Advisory Committee.
· The following parties will be contacted by Harris regarding their ability to attend the first project meeting: Canal Corporation, Cayuga County Planning, Town of Aurelius, Empire State Development Corporation and Sage Stone Engineering. Residents expressing an initial interest are Doug Carter and Dean Kipp.
TRUSTEE REPORTS
Mayor Day asked Mike Nicpon, Fire Chief, to report on the activities at the Fire Department.
· A MOCK MVA drill will be held on Monday, May 16th at the Union Springs High School parking area.
· The rescue boat needs repairs to the bottom before it can be launched. Repairs are underway.
· Annual Banquet is to be scheduled.
· A request is being made to have the County Inmate Program clean the front of the Fire Department building.
· A meeting with the County regarding the new Radio System and the number of portable radios to be provided. Cayuga may receive 1 portable radio. If the Department must purchase the cost is $1,500/portable radio.
· The Emergency Management Office is not the agency to call when residents need to find out where they can obtain sand bags to deal with high water problems. The contact is the Cayuga Fire Department who will assist with obtaining, filling and distributing.
· The new turnout gear for firefighters cost $1,874/set. The Fire Department would like to order 4 sets at a total cost of $7,496. Gear outfits for interior firefighters must be updated every 10 years. Older gear is reused for new firefighters depending on appropriate fit.
o Motion: Ryan moved and Erickson seconded the purchase of 4 sets of gear at a cost of $7,496 to be purchased in the 2011-2012 fiscal year. Motion approved 4/0.
· Future purchase needed: 2500 feet of 2 ½ inch hose at a cost of $177.50/50foot section.
· Motion: by Ryan, second by Ellis to approve the Fire Department's Slate of Officers. Motion approved 4/0. Slate will be appended to these minutes.
· There will be a Memorial Day Service at the Cemetery on May 30th at 9AM with the American Legion.
Cheryl Ziegler-Greer provided a copy of the Recreation Committee minutes of April 28, 2011. Discussion included a reduction in the swim program due to a decrease in funding. Kelly Lyndaker will be asked for her recommendation.
· The application for the beach permit for the Swim Program has been received.
· Lyndaker is considering offering a CPR lesson or seminar. Certification will be submitted before program is offered.
· Barb Palmer's movement class was a success with 13 children signed in for the 2nd class offering. Future discussion will explore the possibility of incorporating the movement class into the actual recreation time.
Shane Ellis reported that wet weather had delayed preparing Lakeview Cemetery from being mowed and cleaned-up. Mowing is now underway.
· Center Street needs attention. This street is a county owned street and George Wethey, Director of County Public Works, would like the Village to take over all road maintenance of county roads inside the Village limits. Mayor Day will contact George Wethey for further discussion.
· Rain has washed out the road at the bottom of the cemetery road where it exits onto Lake Street. Patterson will put down some stone to fill in the cavity.
· Should consideration be given to paving the roadways within the cemetery?
Ron Erickson reported that an update on a grinder pump is not yet available.
· Erickson met with representatives from FEMA and the Cayuga County Emergency Management Services to review any water damage that might have taken place in the Village due to the extensive rains and high lake water levels. The County allotment for damages is $275,000. Erickson explained the Village issue with the Boil Water Advisory due to turbidity. Information was provided regarding opening the gates at the lock to lower the Cayuga Lake level. This will occur once Oneida Lake level has been lowered. Patterson showed the representatives around the Village. FEMA will be sending forms to complete where any water damage can be reported for consideration of funding.
· Shannon Walters reported that Fred Gillette of DEC has approved the use of barley straw at the ponds as an algae inhibitor. Gillette was questioned as to the possible use of zebra mussels if a container was built to keep them within boundaries. This would need the approval of DEC and it is not likely to occur.
· Questions were raised regarding the consent order and the corresponding penalty if the timeframe for corrections are not met. New enforcement guidelines indicate that penalties can only be suspended a certain amount of time. If not in compliance following an extension, penalties can be reinstated.
· Walters indicated there is a new round of funding for "green innovation" projects. The deadline is October 2011.
Chris Ryan reported that the water tank inspection had gone well. Some epoxy needed to be applied and was done the day of the visit. The report is available.
· Boil Water Advisory remains in effect until two water samples taken on consecutive days at 4 locations are within acceptable range.
· Meeting with Patterson, Walters, Ed Ide (Supervisor Town of Aurelius), and Ryan was held to prioritize water projects. Prioritization is as follows:
o Water Intake
o Place marker buoy over water intake
o Repairs to Water Plant by Burns Brothers
o Distribution Study- locate all valves and lines
o Water Loss Study - Doug Smorol of Rural Water to assist in project. Walters will contact Smorol to develop a plan. MRB will be contacted when this study will occur.
· Water Emergency Plan will be reviewed and updated. This will also be added to the Village Annual TimeLine.
· Research on type meters in homes was done at time of March meter readings. Information is being analyzed. Change to new meters will occur on individual basis depending on type of meter now in use showing the least dependency.
SUPERINTENDENT OF PUBLIC WORKS - DAN PATTERSON
Water - The first set of water samples to test for need to continue Boil Water Advisory were taken on May 11, 2011.
· CCHD has told Patterson not to take the quarterly test for trihalomethanes next Tuesday (May 17th) as scheduled. Mayor Day asked Patterson to have CCHD put this directive in writing.
· Retaining wall at Water Plant has washed out.
· Fixed lawn on Water Street following water break this past winter.
Sewer - Force Main broke. Walters to contact Fred Gillette of DEC regarding testing the integrity of the sewer force main.
· Bob Kneaskern, Superintendent of Public Works for Village of Union Springs, will contact Patterson when Grout Tech is finished in Union Springs and will be coming to Cayuga.
Streets - Pot holes on Lake Street will be patched.
· Backhoe overheated and is out of service while repairs are being made. The backhoe has very few hours on it and should not be having this type issue. Patterson has asked for an estimate on trade for new backhoe prior to repair work being done. If backhoe is needed, Patterson will contact Town of Aurelius for assistance. Question: Can CHIPS money be used for purchasing a backhoe?
Parks - are open and being mowed, weather permitting. Bathroom facilities at Harris Park are open.
Cemetery - Two burials are scheduled for Saturday, May 14, 2011.
OLD BUSINESS
· No recommendation on Work Rules review at this time. Ryan requested that the spread sheet for 2011-2012 be updated.
· There is a need for evaluation of employees on an annual basis to show accountability. Former Mayor Mike Coombs had a tool for this activity and Rusinko will send a copy to Mayor Day.
· A meeting has been scheduled on May 18, 2011 with Union Springs Central School Superintendent, Linda Rice, Mayor Day and Shannon Walters to discuss increasing the number of sewer units billed to Cayuga Elementary School.
· One vacancy remains on the Village Planning Board.
· May 17, 2011 is the last day to pay water/sewer bills before being levied onto the Village Tax Roll.
NEW BUSINESS
· Bill Patterson reported on May 5, 2011 that the gazebo in Harris Park was vandalized. 12 spindles had been removed of which 4 were retrieved and 8 are missing. Rusinko will contact the company where purchased to see if additional spindles can be made.
· Ashley Roney has asked to use the gazebo at Harris Park for her wedding on July 23, 2011. Only the ceremony will be held in the Park using the facilities from 10AM-12Noon. Pastor Kevin Grish will be conducting the ceremony. Approval was given.
· The Year-end meeting was set for May 26, 2011 at 6:30PM. Notification will be in The Citizen.
· Notification plan for alerting Salato Garden management when a boil water advisory is in effect has been developed.
· Geneva Rotary has requested use of Harris Park on September 17, 2011 for the Fall Festival Express.
· Village newsletter items need to be the Office by May 24th to be included in the June 1, 2011 issue.
OPEN DISCUSSION BY VILLAGE BOARD
· Mayor Day would like to hold a second Board meeting every month to review sewer and water issues and updates. The day and hours were agreed to be Thursday with May 26th and June 23rd at 7PM. Notification of these meetings will need to be published.
· A proposal from Benn & Company CPA's, PLLC was received. It was suggested by Trespasz & Marquardt, LLP, Bond Counsel for the Village that an independent audit will be necessary when bonds wish to be sold by the Village. The fee schedule for auditing the year ending May 31, 2011 would be $17,500 plus out of pocket expenses.
Additional quotes from CPA firms familiar with Municipal Accounting will be sought.
· The Procurement Policy for 2011-2012 has not been approved. Rusinko sent Trustees the recommendation for such a policy from NYCOM. Further discussion will occur at the June meeting.
CLERK/TREASURER REPORT - JOAN RUSINKO
· Met with Doug Smorol, NYS Rural Water, on April 21, 2011 to review the water reports for 2010 and the first three months of 2011. They calculated an average of 75 gallons/day/person with an average of 4 people per household and arrived at 300 gallons/day time 220 connections = 66,000 gallons usage/day. Not included was the Town of Aurelius pit meter. Smorol recommended installing water meters at the Cemetery, Garage, Bathrooms at Harris Park and McIntosh Ball field, Office Building, Fire Department and Cayuga Memorial Hall to more accurately reflect potential water loss.
Smorol would like to schedule a time with Patterson to check each residence's water lateral connection. To do this, the water shutoff will have to located and blue paint sprayed on blacktop if there is no sidewalk to note shutoff. Smorol has a meter which will check for leaks from the shut-off to the meter.
· Meeting minutes reflect the need to update the Emergency Water Plan to include notification to Salato Gardens when boil water advisories are given.
· May 14, 2011, from 9AM-3PM, electronic devices will be accepted at Cayuga-Onondaga BOCES campus. No charge unless it is a freon device. Cost for freon device is $5.00.
· Budget resolution needed to increase appropriation G9950.9 in the amount of $27,878.50 by appropriating additional fund balance from G599 to reimburse HP8130.2 for 2008-2009 MRB Group invoices.
· Budget for Month ending April 30, 2011 was reviewed. At this time, 92% of General Fund Budget has been expended with 8% remaining to cover May 2011 expenses. 9% of Water Budget remains. Revenue projections exceeded by $641.
· Lt. Doug Butler will have work crew available to do maintenance jobs in mid-May.
· Village Office will be closed Memorial Day, May 30, 2011.
· Rusinko read a letter addressed to Mayor Day and the Board of Trustees stating her decision to retire effective September 1, 2011. Joan has served the Village for 26 years and this decision was not made easily. Motion: by Erickson, seconded by Ziegler-Greer to accept Joan Rusinko's retirement reluctantly and with much appreciation. Motion approved 4/0.
TIME LINE REVIEW
Water Emergency Plan annual review will be added noting updating necessary every 5 years. Updated plan needs to be sent to Cayuga County Health Department.
CORRESPONDENCE
· Letter from Friends of the Railroad, Inc. with an address of Victor, NY was received. This is a non-profit organization formed in 2008 "to support the education and preservation of rail history in our village, town and the Finger Lakes region." They are now asking for written support to convince the FGLK (Finger Lakes Railway Corporation) to restore and revitalize their railroad excursion business in coordination with their growing freight service. Motion: by Ziegler-Greer, second by Ellis to send a letter of support and state the advantage of promotion of tourism and enjoyment of residents for this service. Motion approved 4/0.
ABSTRACT OF VOUCHERS
Motion: by Erickson, second by Ryan to approve the Abstract of Vouchers with the exception of Invoice #080 for Account HP8130.2 to Rochester Museum & Science Center for completion of Phase IB Survey. The amount to be paid will be $3,986.25 since it was the understanding of Engineer Walters that $1,000 had been paid upfront.
