A Local Law for the purpose of controlling consumption of alcoholic beverages within the Village of Cayuga, New York.

TITLE
This Law shall be known as DRINKING OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES IN THE VILLAGE OF CAYUGA

PURPOSE

The purpose of said law shall be to preserve and protect the peace of mind, welfare, and property of all persons residing in the Village of Cayuga by declaring and enforcing certain regulations and restrictions regarding the consumption of alcoholic-beverages on the lands owned or leased by the Village.
  1. Places Designated. No person shall have in his possession any open bottle or container containing liquor, beer, wine or other alcoholic beverage while such person is on any public highway, any public park, public sidewalk, public parking area, or in any vehicle or public place within the Village of Cayuga excepting those premises duly licensed for sale and consumption of alcoholic beverages on the premises wheresoever in said Village.

  2. Motor Vehicle. An open bottle or open container in any vehicle shall be presumptive evidence that the same is in possession of all the occupants thereof in violation hereof.

  3. Issuance of Permits. The Village Board of the Village of Cayuga gives the Village Clerk the right to grant a permit to any benevolent associations or any organized or duly constituted responsible group to use open bottles or containers of alcoholic beverages at any village-owned park for certain specified activities. Permits will be issued only when all applicable Rules and Regulations of the Alcoholic Beverage Control Board have been complied with. Compliance with said Rules and Regulations will not constitute automatic granting of said permit but will only be one of the conditions to be met for such approval.

  4. Violations and Penalties. A violation of this section shall constitute an offense punishable by a fine not exceeding one hundred dollars or by imprisonment for not exceeding thirty days or by both such fine and imprisonment.
