Food and Temporary Food Service

The goal of this program is to prevent illnesses associated with food service establishments.

This program provides services in the following areas:  

  • Issues permits to food service establishments in Cayuga County.
  • Performs inspections of food service facilities.
  • Provides plan review and approval for new or modified food service facilities.
  • Investigates food borne illness outbreaks. 
  • Investigates food service facility complaints. 
  • Provides public information and education concerning food safety issues. 
  • Enforces the requirements of the New York State Sanitary Code.
  • Enforces the New York State Clean Indoor Air Act at food service facilities. 
  • Answers questions from the public regarding food protection in the home. 
  • Performs enforcement actions for violations of the Food Service Establishment codes.

Selling Home Made Foods

Regulatory requirements vary depending on the type of foods you plan to make and how you plan to sell them. You must contact either the New York State Department of Agriculture and Markets or the Cayuga County Health Department.

If you plan to make foods such as certain baked goods, jellies or snack mixes, you may qualify for a Home Processor Exemption from the New York State Department of Agriculture and Markets. This will allow you to prepare food in your home kitchen for wholesale or retail sale at agricultural farm venues. See Information for Home Processors from the Department of Agriculture and Markets.

If you plan prepare and sell foods and are not eligible for a Home Processor exemption from the New York State Department of Agriculture and Markets, you will need to obtain a Food Service Establishment permit.  Your home kitchen cannot be used, however a separate kitchen located in your residence may be acceptable.
